1. ACCEPTANCE OF THESE TERMS

These Terms of Service (“Terms”) govern your access to and use of theArckon Store PH website and your purchase of our products. By using the website, creating an account, or submitting an order, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the website.

You must have legal capacity to enter into a contract. If you are below 18, you may use the store only with the involvement and consent of a parent or legal guardian.

2. PRODUCTS AND AVAILABILITY

We aim to present product names, descriptions, photos, colors, sizes, prices, and availability accurately. Display settings, lighting, and production variations may cause minor differences in color or appearance. Measurements are approximate unless stated otherwise.

Products are subject to availability. Placing an item in your cart does not reserve it. We may set reasonable quantity limits and correct genuine typographical, pricing, inventory, or description errors. If an error affects an order already submitted, we will notify you and offer correction, substitution with your consent, or cancellation and an appropriate refund.

3. ORDERS AND CONTRACT FORMATION

Your checkout submission is an offer to purchase. An automated acknowledgment confirms that we received the order; acceptance occurs when we confirm the order for processing or dispatch it. We may reject or cancel an order for a lawful reason, including unavailable stock, suspected fraud, invalid payment, an obvious error, delivery restrictions, or breach of these Terms.

If we cancel after receiving payment, we will issue a refund using the original payment method or another method agreed with you. You are responsible for providing complete and accurate checkout details and for promptly reviewing your order confirmation.

4. PRICES, TAXES, AND PAYMENT

Prices are shown in Philippine pesos (PHP). Applicable taxes, discounts, and delivery fees are shown at checkout before you submit the order. Promotions may have separate eligibility periods, limits, exclusions, and redemption conditions.

Available payment methods may include cash on delivery, QR payment, and PayPal, as displayed at checkout. You authorize us and the relevant payment provider to process the amount shown. QR orders may require a valid proof of payment. Payment remains subject to verification; altered, duplicate, or fraudulent proof may result in cancellation and appropriate action. PayPal payments are also subject to PayPal’s applicable terms and privacy policy.

5. SHIPPING, DELIVERY, AND PICKUP

We currently deliver within the Philippines only. Available delivery or store pickup options, fees, and estimated timeframes appear at checkout or on our Shipping & Delivery page. Estimates are not guaranteed delivery dates and may be affected by courier, weather, peak-volume, address, safety, or events beyond reasonable control.

You must provide an accessible and accurate delivery address and ensure an authorized person can receive the parcel. Additional costs caused by an incorrect address, repeated failed delivery, refused delivery, or unclaimed pickup may be charged where lawful and disclosed. Please inspect the parcel promptly and contact us about loss, damage, shortage, or an incorrect item so we can investigate and provide the remedy required by law.

6. RETURNS, EXCHANGES, AND REFUNDS

Our voluntary return window and process are explained on the Returns & Exchanges page. Eligibility may depend on the item’s condition, hygiene considerations, original tags and packaging, proof of purchase, and the reason for return.

Nothing in these Terms or our return policy limits remedies that cannot lawfully be excluded. Defective, unsafe, misdescribed, counterfeit, or incorrectly supplied goods remain subject to the rights and remedies provided by the Consumer Act of the Philippines, the Internet Transactions Act of 2023, and other applicable law. A change-of-mind policy does not replace those statutory rights.

7. ACCOUNTS AND WEBSITE USE

You are responsible for keeping account credentials confidential and for activity under your account. Notify us promptly of suspected unauthorized access. You must not misuse the website, attempt unauthorized access, disrupt its operation, introduce malicious code, scrape it at unreasonable volume, impersonate another person, submit false information, commit fraud, infringe rights, or use the website for an unlawful purpose.

We may restrict or suspend access where reasonably necessary to protect customers, the website, our rights, or comply with law. Guest order tracking requires the order number and matching checkout email; you must not attempt to access another customer’s order.

8. INTELLECTUAL PROPERTY

The website and its original branding, text, graphics, product photography, designs, layout, and software are owned by or licensed to Arckon Store PH and are protected by applicable intellectual-property laws. You may use the website for personal shopping only. No license is granted to reproduce, distribute, modify, sell, or commercially exploit our content without prior written permission, except where law permits.

9. THIRD-PARTY SERVICES AND LINKS

The website may rely on or link to independent payment, delivery, hosting, or other third-party services. Their own terms and privacy policies may apply. We are not responsible for an independent third party’s website or conduct, but this does not remove any responsibility we have to you under applicable consumer law.

10. DISCLAIMERS AND LIMITATION OF LIABILITY

To the extent permitted by law, the website is provided on an “as available” basis. We do not guarantee uninterrupted or error-free access. We are not liable for indirect or consequential loss that was not reasonably foreseeable when the contract was formed, or for delay or failure caused by events beyond our reasonable control.

Nothing in these Terms excludes or limits liability, warranties, guarantees, rights, or remedies that cannot legally be excluded or limited, including liability for fraud, willful misconduct, gross negligence, or rights under applicable Philippine consumer-protection law.

11. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the Republic of the Philippines, without limiting any mandatory protection available to you. Please contact us first so we can try to resolve a concern promptly. You may also pursue remedies through the Department of Trade and Industry, another competent regulator, or a court with jurisdiction. Nothing here prevents either party from seeking urgent or legally available relief.

12. CHANGES AND GENERAL TERMS

We may update these Terms prospectively by posting a revised version and date. The Terms in effect when an order is accepted generally govern that purchase. If a provision is found unenforceable, the remaining provisions continue to apply. A delay in enforcing a right is not a waiver. You may not transfer your rights or obligations under these Terms without our consent; we may transfer ours as part of a legitimate business reorganization or transfer, subject to applicable law.
